Terms of Service

Welcome to CreatoHunt. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and CreatoHunt ("we", "us", or "our") governing your access to and use of content, reports, campaigns, and online services (collectively, the "Services") made available through our website at CreatoHunt.com(the "Site").

1. Agreement Acceptance

By using or accessing the Site and/or Services, you agree to abide by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these Terms, in which case the terms "you" or "your" shall refer to that entity. If you do not have such authority, or if you do not agree with these Terms, you may not access or use the Site and Services.

2. Description of Service

CreatoHunt provides a simplified, high-efficiency platform focused on influencer search/research, campaign pipeline management, daily influencer content view tracking, and direct email outreach integrations (e.g., using the Gmail API).

3. User Account Security and Single Account Policy

To access certain features of the Services, you must sign up for an account. You agree to:

• Provide accurate, complete, and up-to-date registration information.
• Maintain the security of your account credentials (username, password, and integration tokens) and notify us immediately of any unauthorized access.
• Use only a single account per person. Creating multiple accounts for abusive or disruptive purposes, or to bypass system limits, is strictly prohibited and may result in permanent suspension of all related accounts without refund.

4. Charged Services, Billing, and Paddle Merchant of Record

CreatoHunt offers a selection of plans including Free, Starter ($49/month), and Scale ($99/month) tiers.

• Merchant of Record: Our order process and subscriptions are conducted and processed by our online reseller, Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles billing inquiries, customer service inquiries related to payments, and tax processing.
• Auto-Renewal: All paid subscriptions are set to automatically renew for the same duration as the initial subscription period unless cancelled. You must cancel your subscription before 23:59 UTC on the last day of the current subscription period to prevent renewal.
• Cancellation: You can cancel your subscription at any time through your account settings or by contacting customer support at quanth@creatohunt.com.
• STRICT No-Refund Policy: Payments and charges for extended subscriptions, reports, and unused features are non-refundable. Downgrading a service plan may result in the loss of campaign lists, features, or database historical depth. We do not accept liability for such loss.
• Taxes: All fees are inclusive of VAT/sales tax where applicable. You are responsible for any indirect taxes or local declarations required in your country.

5. Intellectual Property and Proprietary Rights

The Site and Services (including the aggregated database, platform designs, code, logos, and features) are the exclusive property of CreatoHunt.

• We grant you a limited, non-exclusive, non-transferable, revocable license to access the Site and Services for internal business purposes.
• You agree not to copy, duplicate, resell, distribute, syndicate, adapt, translate, or otherwise create derivative works of any of the Services or databases obtained from the Site.
• You shall not reverse engineer, decompile, disassemble, or attempt to discover the source code of the underlying software.

6. Content Disclaimer and Third-Party Data

The data/content displayed on the Service (e.g., influencer profiles, engagement numbers, and statistics) is gathered from publicly available social network profiles and third-party data providers.

• CreatoHunt does not verify the absolute accuracy or exhaustiveness of third-party data. You use all such information at your own discretion and sole risk.
• Social networks or third-party providers may block, limit, or restrict CreatoHunt's access to certain data from time to time, which may temporarily impact data updates or features.

7. Restrictions on Use

You are strictly prohibited from using the Services for any of the following activities:

• Automated Scrapers and Bots: Utilizing automated programs, crawlers, indexers, screen-scraping tools, spiders, or bots to harvest data from the Site is strictly prohibited.
• Rate Limiting: Submitting requests at an excessive rate (e.g., exceeding 5 requests per second) or trying to bypass API constraints.
• Stalking and Harassment: Using platform details to stalk, harass, or perform malicious actions against any individual or influencer.
• Harmful Content: Storing, transmitting, or uploading illicit, obscene, defamatory, or infringing content.

8. Data Protection and GDPR/CCPA Compliance

CreatoHunt complies with applicable data protection laws. Because our platform processes information related to natural persons (influencers, creators, and subscribers):

• Independent Controllers: When you search the influencer database, both you and CreatoHunt act as independent data controllers. You agree to use, transfer, and process personal data in compliance with GDPR and applicable legislation.
• Controller-Processor Relationship: For features like Campaign Management and Email Outreach (where you determine lists, upload contact addresses, and send emails), you act as the Data Controller, and CreatoHunt acts as the Data Processor. Each party will implement appropriate technical measures.
• Right to Deletion: If an influencer or data subject requests the deletion of their personal information, you are obligated to remove and delete any data/reports you have downloaded or compiled within 72 hours of such request.

9. Email Outreach and Prohibited Spam Actions (Gmail API)

If you connect your Gmail account via the Gmail API, you agree to comply with Google's terms and the following anti-spam restrictions:

• No Spam: You may not use the platform to send unsolicited bulk emails or unsolicited commercial one-to-one emails. Every outreach email must have a valid legal basis (such as consent or legitimate interest) under GDPR/CAN-SPAM.
• Honest Identity: You may not use misleading or false names, return addresses, domains, or subject lines. Using techniques to disguise the point of origin or transmission path is strictly banned.
• Harvested Emails: You may not send emails to addresses obtained via automated Internet harvesting or scraping methods.

10. Warranties and Indemnification

You warrant that any lists, contact info, or email content you upload or send through the Services does not violate laws or infringe third-party rights. You agree to defend, indemnify, and hold harmless CreatoHunt, its affiliates, officers, and employees from any claims, losses, liabilities, or expenses (including legal fees) arising from your breach of data protection laws, spam regulations, or these Terms.

11. Disclaimer of Warranties and Limitation of Liability

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, CreatoHunt DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

CreatoHunt SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS OR DATA) ARISING FROM THE USE OF OR INABILITY TO USE THE SERVICES. IN NO EVENT SHALL CreatoHunt'S TOTAL LIABILITY TO YOU EXCEED THE TOTAL FEES PAID BY YOU TO CreatoHunt IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Account Suspension and Termination

You may delete your account at any time. CreatoHunt reserves the right to suspend or terminate your account or API keys immediately and without refund if:

• You violate these Terms.
• You fail to make payments due.
• You send spam or engage in abusive behavior.
• Required by law or regulatory authorities.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CreatoHunt operates, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved through amicable negotiations; if negotiations fail, disputes shall be settled before the competent courts of the same jurisdiction.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any significant changes by updating the date at the top of this page. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.
